DRIVER’S
LOGS ARIBTRATION DECISION
ARBITRATOR DENIES UNION’S GRIEVANCE
Arbitrator John Kagel has
rendered his Opinion and Decision regarding our Driver’s Logs Arbitration
(2005-ATU-1061/0894), in which he denies the Union’s grievance.
In the Decision, Kagel
stated that the contract does not bar preparation of the logs on the Operator’s
own time given their individual obligation to maintain such “reports”
“independently” of the Employer.
Kagel did not address the
Union’s arguments regarding Employer obligations under the Fair Labor Standards
Board.
The Union has requested
an Executive Session to address our concerns.
We will keep the membership informed of the results of the Executive
Session. We will also give a full account
of the Decision in the next edition of Route 265 -- our Local’s Newsletter.
